Blogging Ins-and-Outs
Blogs have become
ubiquitous. You simply cannot escape them nowadays, unless you’re still using
Morse code to send and receive messages. In fact, blogs are perhaps the biggest
thing to happen to human communications since the advent of the Internet
itself, and it is a rapidly growing medium. Blogs today cover everything from
the politics of war, to the pros and cons of a local school board debate.
Because blogs have become so prevalent, it is important that
bloggers be aware of the laws that may or may not regulate their online writing.
Copyright raises all kinds of legal questions for bloggers.
While the law does not copyright ideas, it does protect the expression of them.
Thus, most original content produced by a blogger is protected as that writer’s
literary creation. In the same way, material “borrowed” by a blogger might
violate copyright law if proper citation is not included. A good rule is, when
in doubt, always attribute.
Trademarks are another area for bloggers to be concerned,
for if a blog reproduces a trademark to label a good or a service, permission
is almost certainly required. Luckily, however, in America at least, the power of free
speech is such that the law often recognizes “trademark parody,” which is using
a trademark to lampoon culture or society.
Other issues for bloggers to consider before publishing
their posts include, defamation, journalistic privilege, and ownership (if
somebody else pays you to blog, then they typically own what you produce). As
blogs continue to grow in popularity, it is likely that the law will provide a
challenge to, and be challenged by, bloggers.
